Those tenancies that do not require a deposit to be protected

Tenancy deposit protection is a legal obligation that covers virtually all Assured Shorthold Tenancy Agreement (ASTs) made from 6th April 2007 in England and Wales.

However, there are several circumstances, where protection is not required, these are normally for those tenancies that are not ASTs. These include situations such as:

-       Resident landlords (i.e. those landlords living in the property)
-       The tenant is a company;
-       The rent is more than £100,000 per year;
-       The tenancy is for a holiday let;
-       The tenancy applies to a university or college renting out its own accommodation to students.
